The Same-Sex Divorce Process in Georgia
The divorce process for same-sex couples is virtually the same as for heterosexual couples. Georgia courts will recognize your divorce whether you got married before or after the Obergefell v. Hodges decision. Because same-sex divorces are still relatively new to Georgia courts, these cases sometimes take a bit longer to resolve than opposite-sex divorces.
During your divorce, we can assist you with matters and disputes involving:
- Property division: In some same-sex marriages, the partners have cohabitated much longer than they have been married. As such, the property division process in many same-sex divorces can be particularly complicated.
- Child custody: Before the Supreme Court’s ruling, two parties in a same-sex couple could not both be listed on a child’s birth certificate. Now, both parents in a same-sex couple can share parental rights whether the child was adopted, born via in vitro fertilization, or otherwise. We can help you with the challenges and complexities that often present themselves during custody disputes in same-sex divorces.
- Child support: Once custody arrangements have been made, child support can help the parent who has primary custody provide for the child. Our attorneys can represent you in efforts to negotiate a fair child support award.
- Alimony: Because many same-sex couples lived together and shared a relationship similar to marriage before they could legally get married, determining a fair alimony award can be a complicated task.
